MTV Dark Scroll Game Contest

These Terms and Conditions (Terms and Conditions) govern your participation in the “MTV DARK SCROLL GAME CONTEST” (the “Game Contest”) whereby viewers of the Program shall be required to play an online game and top the leaderboard by scoring in the game and the participant who tops the leaderboard will be selected as the winner by Viacom18. The Game Contest is conducted by Viacom18 Media Private Limited (“Viacom18/Company” or “We”) who owns and operates an on the over the top internet based digital video platform presently branded as “JioCinema” and/or its other variants whereby some of the Jio Cinema content made available are marked and categorized as “premium” and can be availed by users who have opted for any specific subscription plan either through its mobile application or website or mobile site (hereinafter collectively referred to as “JioCinema) in relation to its show presently “MTV Dark Scroll” (“Program”) to be streamed on the JioCinema and broadcasted on MTV (“Channel”) and being produced by the Company through a third party production house (“Production House”).



These Terms and Conditions apply to all users who intend to participate in the Game Contest. Your participation in the Game Contest constitutes your agreement to follow and be bound by these Terms and Conditions without modification, and all other operating rules, policies and procedures that may be published from time to time by the Company. If you do not agree to these Terms and Conditions, you are advised not to participate in the Game Contest. Please be advised if you choose to continue to participate in the Game Contest, it shall be deemed that you have accepted the Terms and Conditions. The Terms and Conditions are personal to You, and are not assignable, transferable or sub-licensable by You.


The Terms and Conditions in relation to the Game Contest as stated herein is an electronic record in terms of Information Technology Act, 2000 ("Act") and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology (Amendment) Act, 2008. This is a legal and binding agreement between the Participants (as defined later) and Viacom18, that states the terms that govern the Participants participation in the Game Contest through JioCinema (as stated hereinbelow) and/or any other platform as communicated hereunder. By participating in the Game Contest, the Participants hereby unconditionally consents, agrees and undertakes to abide, be bound by and adhere to the terms and conditions stated herein.

1. Eligibility:


a. This Game Contest is organized by Viacom18 and is open to all individual participation who (“You/Participant(s)”):

  1. Are citizens of India and hold valid proof of citizenship and are residing in India;
  2. Are above 16 (sixteen) years of age;
  3. Are viewers of the Program on the Channel and JioCinema;
  4. Have downloaded Jio Cinema application and registered themselves on the said JioCinema either through its mobile application or website or mobile site and is logged in to Jio Cinema
  5. The Participant(s) agree that he/she will be required to submit all valid proofs of name/ age/ address/ nationality/citizenship and/or any other document if and as may be required by Viacom18 from time to time.

b. The Game Contest is not open to the permanent and/or contract employees and directors of the Company, its parent, subsidiary and affiliated companies, advertising and promotion agencies (collectively, "Viacom18 Entities/Company Entities") and each of their immediate family members are not eligible to enter the Game Contest.

2. Game Contest Period:


a. The Game Contest shall tentatively commence from 16th August 2024 and will end on 
1st October 2024 or until such date as deemed fit by Viacom18 or till such other date as determined by Viacom18 ("Game Contest Period") subject to changes as per the discretion of Viacom18.


b. Entries received after the Game Contest Period shall not be entertained and shall be considered ineligible for the Game Contest for that particular Game Contest Period. The Game Contest Period may be extended and/or modified at the sole discretion of Viacom18 and the same shall be updated on Jio Cinema at the discretion of Viacom18 and the Participant(s) shall be responsible to keep themselves updated by checking the terms and conditions / any amended terms and conditions with respect to any change /modification made in the terms thereof and any and all such modifications shall apply to all the Participant(s).

3. Method of Participation:


In order to participate in the Game Contest, the Participant(s) will be required to download Jio Cinema (i.e., mobile application or visit the website/mobile site) and follow the registration process as displayed therein for users to play the game in the manner as prescribed hereinafter. Participation process shall include the following steps:


1. The Participant(s) shall be required to click on the Game Contest banner as displayed on the Jio Cinema application/website/mobile site which will open in webview for registration and the Participant(s) shall be required complete the registration process by entering details/fields which may include such details as, inter alia, i) Name, ii) Age, iii) Address, iv) Nationality, v) email id, vi) online social media accounts (if applicable), vii) Contact number mobile; viii) Contact number landline, etc. Once registered, the page will redirect the Participant(s) to the game page where the Participant(s) can play the game as per the instructions, steps and specifications detailed herein and detailed within the Jio Cinema app/website/mobile site from time to time subject to changes as per the discretion of Viacom18.


2. The game is based on the theme of the Program and shall have 3 levels which will be periodically introduced by Viacom18 as the show progresses at its own discretion.


3. The Participant(s) shall be tasked with spotting as many entities in each level of the game and attempt to top the leaderboard which shall be displayed on the Jio Cinema App.


4. There is no limit to a single player playing the game. The Participant(s) can play the game multiple times without any restrictions.


5. By submitting the information on JioCinema, through documents and /or otherwise, the Participant(s) hereby waives all privacy rights and/or any other rights including but not limited to proprietary rights, copyrights, etc. and/or any privacy expectations that the Participant(s) may have with respect to the use of the information furnished by the Participant(s) in any manner. Viacom18 and/or Production House may use the information for sending out commercial information and/or for other commercial, publicity or promotional purposes and the Participant(s) shall not raise any objection against the same.

4. Selection Of Winner/s:

A. Selection Process:

  1. At the end of every week during the Game Contest Period, Viacom18 and/or its representatives will review the game leaderboard and then select winners for each week. During the entire Game Contest Period, a total of 7 (Seven) winners will be declared (“Winner/s”). Viacom18 reserves the right to increase or decrease the number of Winner/s in its discretion during the Game Contest Period.
  2. The announcement of the weekly winners shall be made every Tuesday until 1st October 2024 or on such dates as might be determined by the Organizer at its discretion. The Winner shall be eligible for Prize as detailed below as per mechanism and conditions laid down in this terms and conditions or otherwise stipulated by the Organizer from time to time.
  3. The Winner/s will be selected by Viacom18, determined as per their sole discretion.
  4. In the event that Viacom18 is of the opinion that none of the Participant(s) topping the game leaderboard are eligible to be selected, then Viacom18 may exercise its discretion not to select any Winner/s.
  5. Viacom18 reserves the right to disqualify any Participant(s) from participating in the Game Contest without assigning any reason. The decision of Viacom18 in this regard shall be final and binding upon the Participant(s).
  6. Mere participation in the Game Contest or being at the top of the game leaderboard does not entitle the Participant(s) to be a Winner.
  7. All decisions of Viacom18 shall not be subject to any appeal of any nature whatsoever. By participating in the Game Contest, it shall be construed that the Participant(s) has waived his/her right to dispute Game Contest and/or any decision(s) made by Viacom18.
  8. Each Participant(s) consents to the use of information supplied by the Participant(s), to the extent possible under any applicable laws of India, in any media for further promotional, marketing and publicity purposes without any further payment or other compensation to the Participant(s) by Viacom18 and its affiliates.
  9. The Winner/s shall not in any circumstances make any claims against Viacom18 or the Viacom18’s affiliates/entities/representatives arising out of or relating to any and all costs, injuries, losses or damages of any kind, including, without limitation due to any technical faults or directly or indirectly, to the winner's participation or non-participation in the Game Contest or any related activity. If the Winner is found to be ineligible, or if he or she has not complied with these terms and conditions, the corresponding Submission/s will not be considered further.
  10. If Viacom18 so elects, Winner/s will be required to submit to a confidential background check to confirm eligibility and may even be required to sign a release letter on the format provided by Viacom18 and help ensure that the Winner/s will not bring Viacom18 Entities into public disrepute, contempt, scandal or ridicule or reflect unfavorably on Viacom18 as determined in their sole discretion.
  11. Verification: The Participant agrees and consents to be contacted anytime by Organizer (at Organizer’s sole discretion) on their e-mail id/contact number provided by the Participant before being considered and declared as a Winner as determined by Organizer. The Participant specifically consents that upon being shortlisted, he/she shall immediately provide Organizer with such information (as asked for by the Organizer (including mobile number, e-mail address, residential address etc)) and also the following documents immediately upon such request by Organizer: a) PAN card b) Proof of identity cum permanent address proof – Aadhar card / Election card/Passport/ permanent Driver’s License c) copy of NOC/consent of guardian/parent (in case the Participant is below the age of 18 (Eighteen) years d) Birth Certificate/Identify certificate from schools such other documents as may be required by the Organizer from time to time for the purpose of the Game Contest, in such manner as required by Organizer. It is hereby clarified that information and documents shall pertain to such Participant only and not of any other person.
  12. For sake of clarity, no Participant will be considered as final Winner, unless when he/she has been specifically declared as a Winner by the Organizer, and not merely when he/she has been contacted by Organizer for verification or any other purpose.
  13. Organizer reserves the right to disqualify a Participant/Shortlisted Participant/Winner at any time, if Organizers is of the opinion that the details and/or documents provided by the Participant/Winner is not to the Organizer’s satisfaction. No questions or communications shall be entertained in this regard for any reason.
  14. Furthermore, the Organizer may at any time either forfeit the Prize or announce another Winner in place of the originally announced Winner if: - the Participant is not a registered user of the JioCinema application - the documents or details of the Participant/Winner is not correct in the opinion of the Organizers; or - documents so required are incomplete, misleading or untrue; or - the Winner/Shortlisted Participant does not have valid documents as may be required for the purpose of the Prize; - he Winner/Shortlisted Participant, do not sign the confidentiality, release letter or any other documents required, if any, by Organizer in relation to the Prize; or - if the Winner do not approach the Organizer at the contact details provided by the Organizer, immediately upon such request by Organizer.
  15. The Organizer reserves the right to disqualify the Participants immediately from the Game Contest if Participants have supplied untruthful, inaccurate, incorrect or misleading details and/or information, of any nature and/or have failed to abide by the Rules and/or are in breach of the terms hereof.
  16. The Organizer may at its discretion publicly announce the name of the Winner.
  17. Mere participation in the Game Contest and making the Game Contest Entries does not entitle the Participants to win the Game Contest or the Prize. The selection process may vary and shall be as per the Organizer’s sole discretion. The Participants /Winner/Shortlisted Participant and/or any third party shall have no right to question the process of selection. The Organizer may determine the correctness, quality, and validity of the Game Contest Entry and Organizer’s assessment in this regard shall be final.
  18. Subject to successful Verification and compliance with the terms and eligibility as contained herein, each Winner as may be declared by the Organizer would be eligible to receive a RealMe Narzo series smart phone used during the shoot of the Program by the show contestants having the approximate value of INR 12,500 (Twelve Thousand Five Hundred only) at the sole discretion of Viacom18 (“Prize”). The Prize shall be handed over to the Winners after verification of the documents as specified herein, and shall be delivered to the Winners depending on their specific location. In case any Winner is located in a remote location where delivery of the Prize is not possible, Viacom18 shall have the right to revoke the delivery of such Prize at its own discretion.
  19. The Participant(s) understand that although the smart phones being awarded as the Prize have been newly purchased by Viacom18 for the purpose of the shooting of the Program, the said phones are not sealed and will be in a used condition. Further, all costs and expenses that are not specifically covered by the Organizer and not set out herein shall be solely borne by the Winner and no monies will be reimbursed by the Organizer and/or the Sponsor. Organizer takes no responsibility, liability to reimburse or compensate in any manner, towards the Winner’s expenses including without limitation any expenses incurred towards travel, food, beverages and/or any other costs that may be incurred by the Winner to avail the Prize or to utilize the Prize. The Organizer shall not be responsible or liable in any manner whatsoever for any incident, accident that may occur during the course of the Winner’s participation and/or otherwise in relation to the Game Contest or during the collection of the Prize. Viacom18 shall not be responsible for the warranty of the Prize awarded nor shall it be liable for any defects or damage which the Prize may have sustained.
  20. By participating in the Game Contest, the Participants represent and warrant that their participation in the Game Contest shall not be in breach of any third party rights or defame/offend any person, sect, cast, etc. and that it shall in no manner infringe any rights including the copyright of a third person/party. In the event of any violation to the aforementioned, Participants shall be disqualified from the Game Contest with immediate effect. By participating in the Game Contest, the Participants also represent and warrant that they shall solely be liable for any and all action (criminal/civil) arising therefrom and shall also be liable to indemnify the Organizer for any loss, claim, dispute, disrepute, disruption caused to it.
  21. The Participants confirm that the Game Contest Entry shall not be obscene, vulgar, defaming, denigrating women, artist, celebrity, third person or children, hurting religious sentiments, depicting violence or against the public policy of India or/and the internal policies of the Organizer.
  22. Inability of any Winner to make himself/herself present to/ avail the Prize for any reason whatsoever shall result in the disqualification of the Winner and disentitlement to the Prize. The Winner shall have no claims whatsoever against the Organizer for any reason.
  23. The Organizer shall have the right to click photographs, take pictures, shoot audio-visuals, tape, record, exhibit or portray them as the Game Contest Winner and/or publish any content recorded during availing their Prize. By participating in the Game Contest and accepting the Prize, the Winner waive all copyrights and any related rights and consents Organizer’s right to click photographs, take pictures, shoot audio-visuals, tape, record, exhibit or portray them as the Game Contest Winner and/or publish any content/ Game Contest Answers submitted by them. The Winner further grant irrevocable consent in perpetuity to use, edit, exhibit, publish and/or exploit the same, in any and all applications including advertising, commercials, promotion, stories, text, illustrations, articles and commercial exploitation, throughout the world, in any and all media, mode or format whether now existing or hereinafter developed, including but not limited to radio, broadcast and television, newspapers, magazines, and electronic media, at any time without the Winner’s further knowledge or consent and without any compensation whatsoever.
  24. The Winner undertakes not to divulge, publicize or disclose any details whatsoever, with respect to availing the Prize by the Winner, to any other person or on any media platform, including on-air, on-print and/or online.
  25. The Organizer shall have the right, at its sole discretion, to change/ modify/ replace or omit the Prize listed above and the Winner shall not have the right to claim any damages or monies from the Organizer. By participating in this Game Contest, the Winner waive their right to make any such or other claims against the Organizer.
  26. The Organizer takes no responsibility, liability or any other expenses for the Winner and does not take any responsibility or liability in case the Prize is cancelled or re-scheduled or replaced for any reason whatsoever.
  27. Notwithstanding anything contained herein, Organizer shall not be responsible to bear or reimburse any costs and expenses incurred by the Winner in availing the said Prize and/or incurred otherwise. All such costs / expenses incurred by the Winner in availing the said Prize and/or incurred otherwise shall be borne solely by the Winner.
  28. All costs and expenses not specifically covered by the Organizer and not set out herein shall be solely borne by the Winner and no monies will be reimbursed by the Organizer.
  29. For the purpose of clarification and avoidance of doubt, the Prize does not include any personal expenses of the Winner and the Winner shall be responsible for any additional expenses/incidental expenses required to be incurred to avail the Prize and/or incurred otherwise.
  30. The Winner hereby represents and warrants that they will comply with all the Rules associated with the Game Contest including but not limited to the Terms & Conditions mentioned herein and associated with the Prize, and that the Winner shall personally be liable for any breach thereto.
  31. The Organizer shall not be responsible for any loss of entries for any reason, whatsoever including, due to any problems caused by telephone lines, service providers, network breakdowns, computer service delays, interruptions, network failures or overloads, or for lost, misdirected or misplaced entries, or for entries received after the Game Contest Period or for any reasons beyond the control of the Organizer.
  32. In the event of unforeseen circumstances beyond the control of the Organizer, and the Prize not being made available to the Winner, or the said Game Contest/ Prize being cancelled, the Winner shall not have the right to claim any damages or monies or replacement of Prizes from the Organizer and by participating in this Game Contest, the Winner waives their right to make any such claims against the Organizer.
  33. The Participants acknowledge that they do not have any medical, physical and/or emotional condition which can jeopardize their eligibility for participation in the Game Contest. The Participants/their legal guardians are fully aware of the paranormal, horror and occult nature of the Program and the game which they are participating in as a part of the Game Contest and the Organizer shall not be liable for any injury, trauma or death caused due to such participation in any manner whatsoever.
  34. The Winner acknowledges that the Organizer shall not be liable for any mishap, injury, accident, untoward incident, physical harm of any nature, death, loss of life or limb, etc., caused to them, including, either before, during or after availing the Prize; or before, during or after the Game Contest; or while traveling to or away from the Venue; and no such accident (etc.) will be attributed to the Organizer and the Organizer shall not be held responsible for the same nor shall the Organizer be liable to indemnify or make good any claim being raised against it, for whatsoever nature.
  35. The Prize shall not be transferable, negotiable and/or redeemable for cash. No request shall be entertained by the Organizer in this behalf. Only the Winner and no other person can claim the Prize for or on behalf of the Winner.
  36. Employees (including their immediate family) of the Organizer, its affiliates and associates and sponsors, are not permitted to participate in the Game Contest.
  37. The Participant unconditionally and freely provides their consent to the Organizer to collect, store, use and process their personally identifiable information which shall include their name, phone number, photographs, complete address, date of birth, email address, social media profile URL (as applicable), Instagram account information etc. for the purpose of enabling registration of a Participant and/or to make the Prize available to the Winner and /or to enable the Organizer to administer and promote and the Game Contest ("Personal Information"). If Participants/Winner do not truthfully provide all requested Personal Information, the Organizer may determine that such Participants/Winner are not eligible to win the Prize in this Game Contest.
  38. The Participant unconditionally and freely provides their consent to the Organizer to pass the Personal Information of the Participant/Winner to others assisting the Organizer in this regard, including its affiliates, associates, authorities, agents, sponsors, employees, prize suppliers, distributors, deliverers and service providers (as applicable).
  39. The Personal Information of the Winner shall be provided by the Organizer to others assisting the Organizer in this regard, including its affiliates, associates, authorities, agents, sponsors, employees, prize suppliers, distributors, deliverers and service providers (as applicable).
  40. The Participants hereby agree and undertake that mere announcement/declaration of being announced as a Winner shall not entitle him/her to the Prize. Only upon fulfilling all Rules mentioned herein, to the satisfaction of the Organizer, including compliance with all precautionary measures and agreeing to the terms of the release letter, shall the winning be validated.
  41. The Participants hereby agree and undertake that they shall not accept or undertake to accept/give or undertake to give, either directly or indirectly, any gifts, commission or other favor, of any kind whatsoever, to facilitate their winning the Game Contest. Any knowledge of such an act shall lead to immediate disqualification of such Participants and the Organizer shall be entitled to take any/all actions against such Participants, as deemed fit by it.
  42. The Organizer shall not entertain any questions, correspondence, enquiries on the manner of conduct of the Game Contest and grant of the Prize from any party whatsoever.
  43. The Participant unconditionally and freely provides their consent to the Organizer to collect, store, use and process their personally identifiable information which shall include their name, phone number, photographs, complete address, date of birth, email address, social media profile URL (as applicable), Instagram account information (as applicable) etc. for the purpose of enabling registration of a Participant and/or to make the Prize available to the Winner and /or to enable the Organizer to administer and promote and the Game Contest ("Personal Information"). If Participants/Winner do not truthfully provide all requested Personal Information, the Organizer may determine that such Participants/Winner are not eligible to win the Prize in this Game Contest.
  44. The Participant unconditionally and freely provides their consent to the Organizer to pass the Personal Information of the Participant/Winner to others assisting the Organizer in this regard, including its affiliates, associates, authorities, agents, sponsors, employees, prize suppliers, distributors, deliverers and service providers (as applicable).
  45. The Personal Information of the Winner shall be provided by the Organizer to others assisting the Organizer in this regard, including its affiliates, associates, authorities, agents, sponsors, employees, prize suppliers, distributors, deliverers and service providers (as applicable).

B- LIMITATIONS OF LIABILITY: BY ENTERING THE GAME CONTEST, EACH PARTICIPANT(S) ACKNOWLEDGES AND AGREES THAT: (I) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE GAME CONTEST ETC., , SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND (II) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED AND ASSOCIATED WITH ENTERING THE GAME CONTEST (IF ANY), NOTWITHSTANDING THE FOREGOING, UNDER NO CIRCUMSTANCES WILL VIACOM18 AND/OR VIACOM18 ENTITIES BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL PUNITIVE, OR INCIDENTAL DAMAGES OR LOST PROFITS, WHETHER DIRECT OR INDIRECT, ARISING IN ANY WAY WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.


C- Participation shall be governed by the terms and conditions as detailed hereinafter. Upon submitting the registration details and clicking on the Game Contest banner on Jio Cinema in accordance with the requirements and criteria as laid down herein, the Participant(s) hereby agrees to have read and understood all the terms and conditions stated herein and agrees to abide by the same.


D- The Terms and Conditions of and in relation to this Game Contest as stated herein, is an electronic record in terms of Information Technology Act, 2000 ("Act") and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology (Amendment) Act, 2008. This is a legal and binding agreement between the Participant(s) and Viacom18, that states the terms that govern the Participant(s)’s participation in the Game Contest through Jio Cinema and/or any other platform as communicated hereunder. By clicking on the ‘Submit’ icon, the Participant(s) agrees to have read and understood the terms and conditions and hereby unconditionally consents, agrees and undertakes to abide, be bound by and adhere to the terms and conditions stated herein. These terms and conditions, contained herein shall subsist until the first airing/streaming of the last episode of the Program and /or any such extended duration as may be deemed fit by Viacom18 and hence, the rules shall continue to apply on the Participant(s).

5- By virtue of participation and registration, the Participant(s) hereby agrees to the following conditions and undertakes as follows:


A- The Participant(s) are competent to contract and do not suffer from any disqualification or such other infirmity which may cause the contract to be void or voidable at the option of the Participant(s).


B- The Participant(s) confirm that he/she is an adult or is a legal guardian of a minor who is entitled to enter into a valid agreement. The Participant(s) acknowledge that he/she has voluntarily chosen at his/her free-will to participate in the Game Contest and is willing to bear all risks, costs & consequences arising from such participation in the Game Contest and/or the Program.


C- The Participant(s) represents that he/she has not been accused or convicted or is otherwise involved in any criminal offence and/or is not under inquiry or trial by the police or judiciary which has not been disclosed to Viacom18 and/or Production House. That the Participant(s) is not required to be present before any authority including police or any court of law for a term of twelve (12) months from the date of application and has no other disability which would prevent his/her participation in the Game Contest.


D- The registration does not guarantee the selection of the Participant(s) as a Winner and such selection including the selection criteria /process shall be as per the sole discretion of Viacom18 at all times. The Participant(s) shall not and waive any right to question the selection/evaluation process, non-selection of the application / entry and/or the selection of any other applicant/Participant(s).


E- The number of Participant(s) who shall be finally selected as Winner/s of the Game Contest shall be at the sole discretion of Viacom18 at all times and decision of Viacom18 shall be final and binding.


F- In the event of large number of registrations, the chance to be selected may be strictly on the first come first basis till closure of the Game Contest Hours for each Game Contest Period. No further requests for participation shall be entertained by Viacom18. Viacom18 reserves its right to reduce / extend the Game Contest Hours, Game Contest Period as per its sole discretion at any point of time. Viacom18 reserves the sole discretion to change/modify the terms of this Game Contest at any time without prior intimation.


G- The Participant(s) acknowledge, agree and undertake to abide at all times by all the rules, regulations, terms and conditions for this Game Contest as laid down herein and as determined / modified from time to time by Viacom18.


H- The Participant(s) and/or Winner/s may be required to sign / execute a declaration/registration form for participation in the Game Contest and/or release letter and/or a declaration form, if any as required by Viacom18 shall govern the Participant(s)’s participation in the Game Contest.


I- Viacom18 shall have the sole discretion to discontinue/cancel the Game Contest at any point of time and the Participant(s) shall not raise any claim due to such discontinuation or cancellation at any time whatsoever.


J- Taking part in the registration process shall be deemed to be consent by the Participant(s) to receive promotional messages about the shows and programs of the Viacom18 and messages relating to the Program from Viacom18 and/or any third party so authorized by Viacom18.


K- In the event of any violation to the aforementioned or in case it comes to the knowledge of Viacom18 that the details submitted by the Participant(s) in the application are not correct or in case the Participant(s) does not meet the Eligibility criteria mentioned in these Terms & Conditions, the Participant(s) may immediately be disqualified from being considered to be a Participant(s) for the Game Contest and shall solely remain liable for any action (criminal/civil) arising therefrom.


L- The Participant(s) who shall be required to submit the KYC documents including documents for age proof, address proof or any such other document as required by Viacom18 within 24 hours (or such other time as sole decided and/or communicated by Viaocm18) of receipt of communication from Viacom18. In case the Participant(s) fails to meet the Eligibility criteria or fails to provide the necessary KYC document within 24 hours (or such other time as sole decided and/or communicated by Viaocm18) of receipt of communication from Viaocm18, Viacom18 shall have a right to disqualify the Participant(s).


M- The Participant(s) hereby agree to indemnify Viacom18 and their respective affiliates, sponsors, directors, officers, employees, agents, representatives from and against any claims that might arise from their actions or omissions or arising from any misrepresentation, or concealment of material facts or breach of any representations, obligations or terms as stated herein.

6- General Terms:

  1. If for any reason the game/Game Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, technical failure in transmission, on Jio Cinema and/or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game Contest, Viacom18 reserves the right, at its sole discretion, to disqualify any individual who may be responsible or who tampers with the entry /Game Contest process, and/or to cancel, modify or terminate the Game Contest and/or any part thereof. Further, Viacom18 reserves the right to take legal action against such Participant(s) who has committed a breach under the Cyber laws (Information Technology Act, 2000 including all its amendments thereof) and/or any other laws as may be applicable from time to time and Viacom18 shall be entitled to such remedies in law as applicable.
  2. Viacom18 shall not be held responsible in the case of a server shut-down or loss of Participant(s)’s data.
  3. Viacom18 shall not be responsible for any delay in receipt or non-receipt or incomplete receipt or corrupt receipt of the details of the Participant(s). Viacom18 shall not be responsible for any technical difficulties or data corruption that may arise during the game. Further, Viacom18 shall not be responsible and/or liable in any manner whatsoever in case the Participant(s) are unable to register their entry and participate in the Game Contest due to failure on part of the internet service provider, facility provider, etc. Winner/s shall be intimated as per the contact details given. Viacom18 does not accept any responsibility in case the Winner/s do not respond to the calls (maximum three call attempts shall be made) or communication from Viacom18 and/or its representatives or Viacom18 is unable to contact the Winner/s due to any incorrect and/or incomplete communication detail provided by the Participant(s) and/or delay in receipt of communication and/or non-receipt of such communication due to technical reasons (such as network errors) or Winner are unable to respond for any reason whatsoever. In such cases, Viacom18 disqualify the said Participant(s) and the Participant(s) shall not raise any claim on Viacom18 in any manner whatsoever.
  4. All the Winner/s shall be either directly contacted by Viacom18 and/or its representatives and the Winner/s for each Game Contest Period shall be announced in a manner as deemed fit by Viacom18 in due course of time including displaying the names of the Winner/s on Jio Cinema/game leaderboards. The Participant(s) shall be solely responsible to check the results of the Game Contest for each Game Contest Period on Jio Cinema from time to time.
  5. The Participant(s) hereby represents that he/she is not under any exclusive contracts with any other third party/ agency or is not under any kind of disqualification under law to enter into an agreement with Viacom18 as the case may be and/or to participate in the Game Contest.
  6. The Participant(s) shall at all times make themselves aware of the selection process and all details regarding the Game Contest which he/she might be informed of or which he/she might learn or come to know of as a Participant(s) in the Game Contest.
  7. Viacom18 reserves the right to change/ modify these terms and conditions and/ or criteria of the Game Contest, at any time at their sole discretion, without any prior notice and without assigning any reasons for the same. The Participant(s) shall make themselves aware of any change in the terms and conditions/rules of the Game Contest by visiting Jio Cinema (app/website/mobile site) from time to time and the Participant(s) shall be bound by any such revised /amended terms and conditions/amended rules. Viacom18 shall not be responsible and/or liable towards any Participant(s) and/or any third party in relation to the same.
  8. The decision of Viacom18 in connection with the Game Contest including without limitation the winning Participant(s) etc. shall be final and binding and is non-Game Contestable. In case of any dispute or difference in respect of this Game Contest, the decision of Viacom18 shall be final and binding on all the Participant(s) including all the person / parties concerned.
  9. Apart from the prospective entitlement of the selected Participant(s) to be declared as Winner and/or published on Jio Cinema and/or otherwise, as per the sole creative discretion of Viacom18, subject to selection and written intimation by Viacom18 to such selected Participant(s) (as decided by Viacom18 as per its sole discretion), the Participant(s)/selected Participant(s) or his/her legal heirs will have no other rights or claims against Viacom18 and their respective affiliates/sponsors, etc. Further, Viacom18 has the sole, unfettered and absolute discretion to select the Participant(s) for participation in the Game Contest and that Viacom18’s decision in this regard is final and absolute.
  10. Viacom18 shall not be liable for any loss, damage, injury, mental/psychological issues like anxiety, depression, stress etc. or even death caused to the Participant(s) during his/her participation in the Game Contest during the Game Contest Period and /or any time thereafter.
  11. Viacom18 will also not be liable for any loss of earnings, employment, opportunity and/or otherwise caused to the Participant(s) and arising as a result of his/her participation in the Game Contest.
  12. Viacom18 shall have the right to disqualify a Participant(s)/Winner and choose another Winner in case any such person is unable to provide an email address and any other relevant details required by Viacom18 to contact the Winner, or for any other reason, as required by Viacom18.
  13. All registrations shall be subject to completion of the procedures by the Participant(s) as per instructions given by Viacom18 or the authorized representatives of Viacom18, if any. Viacom18 shall not be liable for any failure of receipt or incomplete registrations. The Participant(s) shall retain the registration code, voucher code or any other communication sent by Viacom18 in relation to the Game Contest, if any. 
  14. Participation in this Game Contest implies acceptance, without protest, of all the rules set forth by Viacom18 for the Game Contest and the terms and conditions herein contained. Acceptance of the terms and conditions by the Participant(s) irrespective of such participation leading to final selection or not, constitutes permission for Viacom18 and/or any party authorized by Viacom18 to click photographs, call and/or record videos of the Participant(s) through any mode/medium and use the Participant(s)’s name, photographs, likeness, voice, audio-video, comments for advertising and promotional purposes in any mode, media, format, medium for worldwide territory for purposes of advertising and trade without any compensation whatsoever.
  15. To enable registration of a Participant(s), personally identifiable information which may include without limitation name, complete address, date of birth, citizenship details, passport details, email id, etc. of the Participant(s)/Winner ("Personal Information") may be collected by Viacom18 to enable the Viacom18 to administer and promote this Game Contest and the Winner/s. If Participant(s) do not truthfully provide all requested Personal Information, Viacom18 may disqualify such Participant(s) from this Game Contest. The Participant(s) agree and confirm that any information provided as part of participating in the Game Contest shall be their own, and the Participant(s) shall at no time submit any contact details which belong to a third party.
  16. The Participant(s) does not and shall not have any right to receive or claim any remuneration/compensation, fees at any time whatsoever, towards participation in the Game Contest and/or any party authorized by Viacom18 and further the Participant(s) hereby irrevocably grants and assigns to Viacom18, free and clear of any and all claims, all of the Participant(s)’s rights and interests in suchcContent / recording exclusively and in perpetuity, throughout the world, and in all media, now or later known or devised.
  17. The Participant(s) hereby represents and warrants that he/she will comply with all the terms and conditions stated herein including without limitation all rules, regulations, policies as communicated by Viacom18, and/or its parent, subsidiary, and affiliate companies in relation to the Game Contest.
  18. Under no circumstance, shall Viacom18 and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant(s) and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever. The Participant(s) specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against Viacom18 and/or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Game Contest / Program.
  19. The Participant(s) hereby agree and undertake that they shall not accept or undertake to accept or give or undertake to give, either directly or indirectly, any gifts, commission or other favor, of any kind whatsoever, to facilitate their winning the Game Contest. Any knowledge of such an act shall lead to immediate disqualification of such Participant(s) and Viacom18 shall be entitled to take any and all action(s) against such Participant(s), as deemed fit by it.
  20. The Participant(s) agrees to indemnify and hold harmless Viacom18 its affiliates and their respective employees, officers, directors and agents, sponsors, contractors, etc. from and against any claim, loss, liability, damages, cost (including legal costs) of any person, firm or corporation, including, without limitation, legal fees, arising out of any breach by the Participant(s) of any representations, misrepresentations or concealment of material facts and/or the Participant(s)’s actions or omissions while participating in the Game Contest and/or the Program and/or breach of any terms of this agreement, warranty, performance and/or any of the terms and conditions as stated herein or in event if any of Viacom18’ rights get affected in any manner whatsoever. In the event of any claim, the Participant(s) will promptly adjust, settle, defend or otherwise dispose of such claim at its sole cost. If the Participant(s) is not diligently and continuously pursuing this matter, Viacom18 may take such action on behalf of itself and/ or as attorney for the Participant(s), to adjust, settle, defend or otherwise dispose of such claim, in which case the Participant(s) shall, reimburse Viacom18 for any costs and penalties incurred thereof or such other indemnity in the amount thereof..
  21. The grant of rights, representations, warranties, indemnities given by the Participant(s) and the Participant(s)’s confidentiality obligations contained herein and any such provision that is intended to survive and/or by its very nature should survive, shall survive the expiration of the term as contained herein.
  22. The terms and conditions shall be governed, interpreted by and construed in accordance with the laws of India and the Courts of Mumbai, India shall have sole and exclusive jurisdiction over any suit or other proceeding arising out of or based upon this terms and conditions.

I HEREBY AGREE, CONFIRM AND DECLARE THAT THE INFORMATION I HAVE PROVIDED / SUBMITTED HEREIN IS TRUE AND CORRECT AND I FURTHER AGREE THAT I HAVE READ AND UNDERSTOOD THE TERMS AND CONDITIONS FOR MY APPLICATION/PARTICIPATION AND I HEREBY CONFIRM TO COMPLY WITH THE SAME. ALL INFORMATION GIVEN BY ME, WHETHER ORALLY OR IN WRITING IS TRUE AND COMPLETE AND THAT I SHALL BE RESPONSIBLE AND LIABLE TO INDEMNIFY VIACOM18, IT’S AFFILIATES, ITS LICENSORS, PRODUCTION HOUSE, CONTRACTORS/REPRESENTATIVES/AGENTS/PARTNERS AGAINST ANY LOSS/DAMAGE/CLAIMS, ETC. ARISING DUE TO ANY MISREPRESENTATION AND/OR INCOMPLETE INFORMATION PROVIDED BY ME AND /OR ANY ACT AND/OR OMISSION ON MY / PART AND I AGREE TO BE BOUND BY THE RULES AND TO THE TERMS AND CONDITIONS SET OUT ABOVE.
